Terms & Conditions

By accessing or using Mmall.us (the “Site”) or the Mmall mobile application (the “App”), collectively referred to as the “Platform,” you agree to be bound by these Terms and Conditions, along with our Privacy Policy and Returns & Refund Policy. Please read these Terms carefully before using the Platform.

1. Introduction

Welcome to Mmall.us (“Mmall,” “we,” “us,” or “our”). We operate an online marketplace, and these Terms govern your access to and use of the Platform, including all related websites, mobile applications, services, and tools.

By using the Platform, you acknowledge and accept these Terms and Conditions (the “User Agreement”) and agree to comply with them. If you do not agree to be bound by these Terms, you must refrain from using the Platform.

This Platform is owned and operated by MUST (Pvt.) Limited. We reserve the right to change, modify, add, or remove portions of these Terms at any time without prior notice. Your continued use of the Platform constitutes your acceptance of those changes.

2. Account Responsibility

To use certain features of the Platform, you may be required to create an account and provide accurate personal information. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

You agree to:

  • Maintain accurate and up-to-date account information at all times.

  • Immediately notify us of any unauthorized access or security breach.

  • Accept full responsibility for all actions taken under your account, whether authorized or not.

Mmall reserves the right to suspend or terminate your account at any time for any reason, including suspected misuse or violation of these Terms, without prior notice.

3. Privacy

Please refer to our [Privacy Policy] to understand how we collect, use, and protect your personal data. By using the Platform, you consent to our handling of your information in accordance with the Privacy Policy and applicable laws.

If you do not agree with our data handling practices, please discontinue use of the Platform.

4. Platform Use and Transactions

Mmall.us provides a platform for users to browse and purchase products listed by various sellers at indicated prices. Mmall acts solely as a facilitator and is not directly involved in the transaction or contract between buyers and sellers.

You acknowledge that:

  • The purchase contract is strictly between you and the seller.

  • For online payments, the transaction is between you, the payment gateway provider, and/or your card-issuing bank.

Mmall is not responsible for any transaction-related issues between users and third-party payment providers or sellers.

5. Platform Availability

We aim to maintain continuous access to the Platform. However, due to technical, maintenance, or upgrade reasons, access may occasionally be interrupted or suspended. Mmall will not be held liable for any disruption or delay in service.

6. User License

By using the Platform, you confirm that you are at least 18 years old or using the Platform under the supervision of a parent or legal guardian.

Mmall grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform strictly for personal shopping purposes. Commercial use or use on behalf of a third party is strictly prohibited unless explicitly authorized in writing by Mmall.

You may not:

  • Copy, reproduce, modify, or sell any part of the Platform or its content.

  • Use bots, data mining tools, or similar techniques to extract content.

  • Frame or mirror any part of the Platform without prior written consent.

  • Use Mmall trademarks, logos, or proprietary content without express authorization.

  • Register multiple accounts or impersonate another person or entity.

Any violation of these restrictions may result in the immediate suspension or termination of your account, and Mmall may take legal action where applicable.

7. Product Information

All product details, including descriptions, prices, stock availability, features, and add-ons, are provided by third-party sellers. Mmall does not guarantee the accuracy or completeness of this information.

Opinions or reviews posted by users on the Platform represent individual views and do not reflect the views of Mmall.

8. YOUR CONDUCT

You must not use the Platform in any way that causes, or is likely to cause, the Platform or access to it to be interrupted, damaged or impaired in any way. You must not engage in activities that could harm or potentially harm the Platform, its employees, officers, representatives, stakeholders or any other party directly or indirectly associated with the Platform. You are responsible for all electronic communications and content sent from your computer to us, and you must use the Platform for lawful purposes only. You are strictly prohibited from using the Platform:

  • For fraudulent purposes, or in connection with a criminal offense or other unlawful activity.

  • To send, use, or reuse any material that is not your own or that is illegal, offensive, deceptive, misleading, abusive, harassing, blasphemous, defamatory, libellous, obscene, pornographic, paedophilic, or menacing; or that promotes hatred, racism, or physical harm; or that violates copyright, trademark, confidentiality, privacy, or proprietary rights.

  • To upload material containing viruses, malicious code, or harmful components.

  • To cause annoyance, inconvenience, or needless anxiety.

  • For any purpose not intended by Mmall.us.

9. YOUR SUBMISSION

Anything submitted to the Platform, including comments, suggestions, or reviews, becomes the sole property of Mmall. You grant Mmall the right to use the name and content submitted. You must not use false credentials or impersonate others. Mmall may remove submissions without notice.

10. CLAIMS AGAINST OBJECTIONABLE CONTENT

Mmall hosts a wide range of user-submitted content. If you believe any content is illegal or violates these terms (e.g. racist, abusive, defamatory, obscene, or threatening to national security), notify us at info@mmall.us with complete details (including identity of the objecting party, proof, and contact info). Incomplete complaints may not be processed.

11. CLAIMS AGAINST INFRINGING CONTENT

If your intellectual property is being infringed, contact info@mmall.us with all relevant proof. False claims may lead to legal action. Mmall respects IP rights but does not mediate exclusive distributor disagreements.

12. TRADEMARKS AND COPYRIGHTS

Mmall.us, Mmall, Mmall logo, and other visual assets are trademarks or trade dress of Mmall. These must not be used without permission or in any misleading way. All content and code on the Platform remain Mmall's property and are protected by copyright laws.

13. DISCLAIMER

You use the Platform at your own risk. Mmall does not guarantee product quality, safety, legality, or merchantability and is not responsible for seller behavior. All content is provided “as is,” and Mmall shall not be liable for any damages arising from product use or platform interaction.

14. INDEMNITY

You agree to indemnify Mmall, its parent company, affiliates, and employees from claims or actions arising from your breach of these terms or applicable laws.

15. THIRD PARTY BUSINESSES

Mmall hosts third-party sellers and links to external sites. Mmall is not responsible for their offerings or content. You should review their policies before transacting.

16. COMMUNICATIONS

By using the Platform, you consent to receive communications from Mmall (via email, SMS, or call). Mmall monitors buyer-seller interactions and may take necessary action against violations.

17. LOSSES

Mmall is not liable for personal or business losses resulting from the use of the Platform.

18. AMENDMENTS

Mmall reserves the right to amend policies, terms, and Platform features at any time. Your continued use of the Platform implies agreement with the latest version.

19. EVENTS BEYOND OUR CONTROL

Mmall is not liable for delays or failures due to events outside our control.

20. WAIVER

Failure to act upon a breach does not waive Mmall’s right to act on future or similar breaches.

21. TERMINATION

Mmall may terminate your account or access to the Platform without notice. You must stop using the Platform immediately after termination. Dissatisfaction with the Platform entitles you only to stop using it.

24. OUR SOFTWARE

You may use Mmall’s software solely to access services. Any misuse, reverse engineering, or redistribution is prohibited. We may update the software at any time.

25. CONDITIONS OF SALE (BETWEEN SELLERS AND CUSTOMERS)

Please read these conditions carefully before placing an order with sellers on Mmall. Placing an order signifies your acceptance of these conditions.

26. CONDITIONS RELATED TO SALE OF THE PRODUCT OR SERVICE

This section governs how products and services are sold on Mmall and outlines the roles of sellers and customers.

28. RESELLING Mmall PRODUCTS

Reselling Mmall products for business purposes is strictly prohibited. If any unauthorized individual is found engaging in such activity, Mmall reserves the right to take legal action.

29. TAXES

You are responsible for the payment of all fees, costs, and charges associated with the purchase of products from the Platform. You also agree to bear all applicable taxes in accordance with prevailing law.

30. COMMUNICATING WITH US

By visiting the Platform or communicating with us via email, SMS, or phone, you agree to receive communications from Mmall electronically. You must provide a valid phone number when placing an order. We may contact you through email, SMS, phone call, website notifications, or other communication methods. For contractual purposes, you consent to receiving all such communications regarding your use of the Platform and agree to treat them with the same importance as written correspondence.

31. LOSSES

Mmall will not be liable for any personal or business losses, including (but not limited to) loss of profits, revenue, data, goodwill, contracts, anticipated savings, or any indirect or consequential loss that could not be reasonably foreseen when you began using the website.

32. AMENDMENTS TO CONDITIONS OR ALTERATIONS OF SERVICE AND RELATED PROMISE

Mmall reserves the right to change any policy, these terms and conditions, or any part of the Platform at any time. Any changes will be effective at the time they are posted unless required by law to apply retroactively. If any term is deemed invalid or unenforceable, it will be considered severable and will not affect the validity of the remaining terms.

33. EVENTS BEYOND OUR CONTROL

Mmall shall not be held responsible for delays or failure to meet our obligations due to events beyond our reasonable control, including but not limited to natural disasters, war, strikes, cyberattacks, or any unforeseeable circumstances.

34. WAIVER

You acknowledge that Mmall is a private commercial entity and reserves the right to conduct business to meet its objectives as it sees fit. If you breach any condition on the Platform and we choose not to act, Mmall still retains the right to exercise its remedies in future situations where you breach these conditions.

 

36. REPRESENTATIONS AND WARRANTIES

Mmall makes no specific representations or warranties as to the quality, value, or merchantability of products or services sold by third parties. We do not endorse or support any product listings or services sold by Sellers on the Platform. Mmall is not responsible for any non-performance, delayed services, or disputes arising between Buyers and Sellers. All transactions and obligations are solely between you and the Seller. Mmall does not own the goods and assumes no legal rights or liabilities in such cases.

Errors in pricing, stock availability, or descriptions due to technical or typographical issues may occur, and Mmall reserves the right to cancel any such orders without prior notice. Any payments made in such cases will be refunded as per our refund policy.
